TERMS OF
SERVICE
THE TERMS AND CONDITIONS GOVERNING USE OF EASYPROSERVE'S SERVICES.

1. ACCEPTANCE OF TERMS
By engaging EasyProServe for process serving services — whether by submitting a file, sending an email, or making a telephone request — you agree to be bound by these Terms of Service. If you do not agree to these terms, do not engage our services.
2. SERVICES PROVIDED
EasyProServe provides professional process serving services in Alberta, Canada, including but not limited to: personal service of legal documents, substitutional service, affidavit of service preparation, Commissioner of Oaths services, and court document filing (COJ). Service is provided in accordance with the Alberta Rules of Court and applicable legislation.
3. CLIENT RESPONSIBILITIES
As a client of EasyProServe, you agree to:
- — PROVIDE ACCURATE AND COMPLETE INFORMATION ABOUT THE PARTY TO BE SERVED
- — PROVIDE CLEAR, LEGIBLE COPIES OF ALL DOCUMENTS TO BE SERVED
- — DISCLOSE ANY KNOWN SAFETY CONCERNS RELATED TO THE PARTY OR ADDRESS
- — PAY FEES AS QUOTED AND AGREED PRIOR TO SERVICE
- — ENSURE YOU HAVE THE LEGAL RIGHT TO SERVE THE DOCUMENTS IN QUESTION
4. PAYMENT TERMS
Service fees are as quoted in writing prior to commencement of service. Payment is due upon completion of service or as otherwise agreed in writing. Rush service fees are due upon confirmation of the rush request. For new clients, prepayment or credit card authorization may be required. EasyProServe reserves the right to withhold affidavits pending payment.
5. UNSUCCESSFUL SERVICE
EasyProServe makes reasonable attempts to complete service as requested. In the event service cannot be completed after the agreed number of attempts, a failed service report will be provided. Fees for unsuccessful service attempts are payable as follows: a reduced fee covering attempted service may apply. Specific terms will be outlined in your service agreement.
6. LIMITATION OF LIABILITY
EasyProServe's liability is limited to the fees paid for the specific service at issue. EasyProServe is not liable for delays caused by inaccurate information provided by the client, acts of the party being served, court delays, or circumstances beyond our control. EasyProServe is not responsible for legal outcomes resulting from served or unserved documents.
7. CONFIDENTIALITY
All case information and legal documents submitted to EasyProServe are treated as strictly confidential. We do not disclose client or case information to third parties except as required to complete the requested service or as required by law.
8. GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Alberta.
9. CHANGES TO THESE TERMS
EasyProServe reserves the right to modify these Terms of Service at any time. Updated terms will be posted to this page. Continued use of our services after any modification constitutes acceptance of the revised terms.
